BMI Bornstein LLC In the News

BMI and its attorneys fight for property rights in various venues and formats. Recently the City of Evanston is considering legislation which requires its landlords to offer lifetime leases to every tenant. Aron Bornstein has been on the forefront of the effort to stop housing providers from losing control of their own units. This has been reported in the below articles.

According to the group’s chairman, Aron Bornstein, ‘If they’re pro-real estate or pro-development,’ then the group might give a politician a check, Bornstein said.

He says that years ago, the PAC focused on an eviction moratorium, but today is interested in issues ranging from “granny flats” to property taxes.

Landlord Aron Bornstein spoke against the proposed amendments, saying the amendments were unfair to landlords because tenants only had to give landlords a 30-day notice of lease non-renewal, but a landlord had to give a tenant 90 days' notice. He also said the 90-day notice would effectively remove monthly leases, resulting in unintended consequences.

Currently, housing providers typically arrange leases 60 to 70 days in advance, according to Aron Bornstein, an Evanston housing provider. Bornstein said while he believes the changes are “well-intentioned,” he agrees with Schermerhorn that the student housing market will be impacted dramatically by the amendments.

Speaking on behalf of North Shore Housing Providers, property tax attorney Aron Bornstein gave a presentation responding to the drafted ordinance. He called Just Cause ‘bad’ and ‘unethical,’ and said it will cause an ‘endless circle of misconduct’ by bad tenants.

Property owner Aron Bornstein also gave the example of violence occurring between two tenants, a case where he said the proposed just cause law would prevent him from evicting the perpetrator renter. But committee members quickly pointed out that something like violence or abuse would count as a just cause.
